Brief overview of the rate schedule used to determine the amount of notaries’ fees for services subject to regulation
Law no. 2015-990 of 6 August 2015, decree no. 2016-230 of 26 February 2016, the order of 26 February 2016, and the order of 28 February 2020 set the regulated rate schedules for notaries.
The price of notaries’ services is therefore the same regardless of the client, the notary, or the geographic area. The rate is either fixed or proportional to the capital sums involved in the transaction.
Since 1 January 2021, a notarial office may grant its clients a discount on its rates. As the discount rates are fixed and identical for all clients, they are not negotiable. Where several notaries take part in the same service, each notary’s discount is deducted from the share of the rate due to them.
Discount rate as of 1 April 2026: To date, no discount is granted by this office.
Notaries may also act as advisors, or as drafters of certain deeds not subject to a set fee. In such cases, they are remunerated under a fee agreement freely negotiated with their client, provided that these services are not subject to the aforementioned fee schedule.
Article R444-16 of the Commercial Code
(created by Decree no. 2016-230 of 26 February 2016 – art. 2)
“Except for those fees due under a court mandate, the fees collected pursuant to the third paragraph of Article L. 444-1 are freely set between the professional and the client, under the conditions and according to the procedures provided for by this text, and subject to oversight by the professional body designated for each profession by order of the Minister of Justice. In the event of a dispute, these fees shall be set by the judge responsible for fee assessment.”
