1. Services offered
Pargade Notaires offers the following services:
- Drafting of notarial deeds (sale, gift, will, companies, intellectual property, digital assets)
- Legal consultation and assistance (individuals, artists, professionals, institutions, businesses).
Any applicable fee discounts and professional fees are stated in euros inclusive of tax (VAT included) and are available at https://pargade.notaires.fr/pargade-notaires/#Tarifs and upon request.
2. Payment terms
Fees and emoluments are payable by:
- Bank card (via our secure platform)
- Bank transfer
A deposit must be paid prior to the service being rendered. An invoice is issued upon completion of the fee assessment.
3. Funds held by the notarial office
Sums held by notaries on behalf of third parties, for whatever reason, are deposited in current accounts opened at the Banque des Territoires, through Treasury accountants acting as agents of that institution. Only third-party funds may be deposited in these accounts, and they may only be debited to settle the matters that gave rise to the deposits.
Sums deposited in current accounts that remain held after a period of three months are transferred by the notaries to so-called mandatory deposit accounts opened at the Banque des Territoires. These accounts may only be debited or credited in relation to the current accounts, and all movements are tracked on a case-by-case basis.
4. Anti-money laundering
Titles VI and VII of the French Monetary and Financial Code (Articles L562-1 et seq., L574-1 et seq.), as well as Articles R562-1 et seq. of the regulatory section of that Code, impose two obligations on notaries:
— a “suspicious transaction reporting” obligation, whereby the notary must communicate to the competent authorities information on certain transactions for which they are approached by their clients;
— “due diligence obligations“, which require them, on the one hand, to carry out various checks on their clients’ identity and the origin of the funds used, and, on the other hand, to put in place within their practice information and alert procedures for their staff to facilitate the detection of suspicious transactions.
5. Right of withdrawal
In accordance with notarial regulations, notarial deeds are not subject to a right of withdrawal, except as provided by law.
6. Video conferencing accreditation
In accordance with notarial regulations, the notarial office is equipped with two accredited video conferencing systems (ADNOV certification andNAVISTA certification) for the signing of electronic authentic instruments.
7. Archiving
Deeds and client data are retained for 10 years, in accordance with legal requirements.
8. Disputes
In the event of a dispute, the client may contact the Paris Chamber of Notaries.
